Hear, my son, the instruction of your father and don't forsake the teaching of your mother (Mishlei 1:8). Get into the habit of always speaking calmly to everyone. This will prevent you from anger, a serious character flaw which causes people to sin. As our Rabbis said (Nedarim 22a):Whoever flares up in anger is subject to the discipline of Gehinnom as it is says in (Koheles 12:10), "Cast out anger from your heart, and [by doing this] remove evil from your flesh." "Evil" here means Gehinnom, as we read (Mishlei 16:4): "...and the wicked are destined for the day of evil." Once you have distanced yourself from anger, the quality of humility will enter your heart.This radiant quality is the finest of all admirable traits (see Avodah Zarah 20b), because (Mishlei 22:4), "Following humility comes the fear of Hashem."

Through humility you will also come to fear Hashem. It will cause you to always think about (see Avos 3:1) where you came from and where you are going, and that while alive you are only like a maggot and a worm, and the same after death. It will also remind you before Whom you will be judged, the King of Glory, as it is stated (I Melachim 8:27; Mishlei 15:11), "Even the heaven and the heavens of heaven can't contain You" -- "How much less the hearts of people!" It is also written (Yirmeyahu 23:24), "Do I not fill heaven and earth? says Hashem."

When you think about all these things, you will come to fear Hashem who created you, and you will protect yourself from sinning and therefore be happy with whatever happens to you. Also, when you act humbly and modestly before everyone, and are afraid of Hashem and of sin, the radiance of His glory and the spirit of the Shechina will rest upon you, and you will live the life of the World-to-Come!

And now, my son, understand and observe that whoever feels that he is greater than others is rebelling against the Kingship of Hashem, because he is adorning himself with His garments, as it is written (Tehillim 93:1), "Hashem reigns, He wears clothes of pride." Why should one feel proud? Is it because of wealth? Hashem makes one poor or rich (I Shmuel 2:7). Is it because of honor? It belongs to Hashem, as we read (I Divrei Hayamim 29:12), "Wealth and honor come from You." So how could one adorn himself with Hashem's honor? And one who is proud of his wisdom surely knows that Hashem "takes away the speech of assured men and reasoning from the sages" (Iyov 12:20)!? So we see that everyone is the same before Hashem, since with His anger He lowers the proud and when He wishes He raises the low. So lower yourself and Hashem will lift you up!

Therefore, I will now explain to you how to always behave humbly. Speak gently at all times, with your head bowed, your eyes looking down to the ground and your heart focusing on Hashem. Don't look at the face of the person to whom you are speaking. Consider everyone as greater than yourself. If he is wise or rich, you should give him respect. If he is poor and you are richer -- or wiser -- than he, consider yourself to be more guilty than he, and that he is more worthy than you, since when he sins it is through error, while yours is deliberate and you should know better!

In all your actions, words and thoughts, always regard yourself as standing before Hashem, with His Shechinah above you, for His glory fills the whole world. Speak with fear and awe, as a slave standing before his master. Act with restraint in front of everyone. When someone calls you, don't answer loudly, but gently and softly, as one who stands before his master.

Torah should always be learned diligently, so you will be able to fulfill it's commands. When you arise from your learning reflect carefully on what you have studied, in order to see what in it that you can be put into practice. Examine your actions every morning and evening, and in this way every one of your days will be spent in teshuvah (repentance).

Concentrate on your prayers by removing all worldly concerns from your heart. Prepare your heart before Hashem, purify your thoughts and think about what you are going to say. If you follow this in all your daily actions, you will not come to sin. This way everything you do will be proper, and your prayer will be pure, clear, clean, devout and acceptable to Hashem, as it is written (Tehillim 10:17), "When their heart is directed to You, listen to them."

Read this letter at least once a week and neglect none of it. Fulfill it, and in so doing, walk with it forever in the ways of Hashem, may he be blessed,so that you will succeed in all your ways. Thus you will succeed and merit the World to Come which lies hidden away for the righteous. Every day that you shall read this letter, heaven shall answer your heart's desires. Amen, Sela!

After lighting the Hanukah candles, one should recite the hymn, "Hanerot Halalu," which contains thirty-six words, corresponding to the thirty-six candles lit over the course of the eight days. It is then customary to recite "Mizmor Shir Hanukat Ha'bayit" (Tehilim 30), and then to recite seven times the final verse of Tehilim 90 ("Vi'hi No'am") and Tehilim 91 ("Yosheb Be'seter Elyon").

Each night of Hanukah (starting from the second night), the newest candle is positioned to the left of the previous night's candle. Thus, on the first night one positions the candle on the extreme right, adding one candle to the left each subsequent night. When one lights the Hanukah, he lights from left to right, meaning, the newest candle first.

I would like to say that my perception of Torah that I learned over the years is that the whole of Torah, with its different texts and traditions, encompasses all interpretations and that the Laws/Halachah (lit. the way to go/the path) is the grounding element.

Also, I believe, Rabbi Pinchas Winston presents Torah well by coupling it with the Pshat/external aspect of Kabbalah. The other levels of Kabbalah; I believe, should not be touched by the unlearned, non-truly righteous non-G-d fearing persons for it all can be grossly misused. Meanwhile; adherance to the laws whether be it the 613 which includes the ten commandments for the Jew or the 7 Noahide Laws for the non-Jew (embedded in the 613 given at Mount Sinai), is important. It binds each of us to the HaBoreh, HaKadosh Baruch Hu/The Creator, The Holy One Blessed be He.

As for Tikkun/rectification, I believe we need to strive for the unification of all layers of the soul and that is by adhering to the laws in the physical and spiritual levels and trying to avoid idol worship which can also manifest as anger from the spiritual level.

3. Neshama = Breath - The manifestation of Divine energy in the world - of creation and the notion of coming into being from nothingness - intellectual understanding to commune with G-d (This is usually the level most attain)

4. Chiya: = Living - The level of Chiya/Chaya communes with G-d as He transcends the worlds, conciousness is of knowing what G-d is not (I believe Moshe Rabbeinu attained this level, if I am correct)

5. Yechida = Oneness - The true conciousness and attachment - cleaving and reflecting Hashem

Chiya and Yechida usually hovers over us instead.

PERCEPTIONS

Parashas Balak

Balak, the son of Tzipor was the king of Moav at that time. He sent messengers to Bilaam, the son of Be’or [who resided in] Petor, by the river of the land of his people. He called for him, saying, “There is a people that left Egypt, which now cover the face of the earth opposite me. I plead with you to come and curse this people for me; they are too mighty for me. Maybe I can be victorious and drive them out of the land. I know that the one you bless is blessed, and the one you curse will be cursed.” (Bamidbar 4-6)

One could truly make a life study out of this week’s parsha. Between the lessons about life in this world, and the many prophecies about the End-of-Days, there is much to be mined from Parashas Balak.

There are themes and there are sub-themes. And, all of them are masterfully interwoven in a way that only God can do, allowing for the story to flow uninterrupted, even though some of it takes place over the course of hundreds of years, adding an additional message: the present is often the past repeating itself on a different plane.

For example, Bilaam was previously Lavan, Ya’akov Avinu’s father-in-law, the father of Rachel and Leah. This soul connection is actually hinted to in their names: BAIS-LAMED-Ayin-Mem and LAMED-BAIS-Nun, which, according to the Arizal, have a primordial origin:

The evil of Hevel’s Nefesh is represented by the letters Bais-Lamed, which is the sod of the verse, “Such judgments, they do not know — Bais-Lamed” (Tehillim 147:20). For, these two letters refer to the Klipos, and the Bais-Lamed of “Bilaam.” (Sha’ar HaGilgulim, Ch. 29)

In other words, there was a part of Hevel that was good, and a part that was evil. The evil part, represented by the Bais-Lamed of “Hevel,” went to Lavan. Hence, his name incorporated these two letters, revealing the basis of his own evil, just as they did much later on in history, in the name “Bilaam.”

Eventually, Bilaam reincarnated into Navel — Nun-BAIS-LAMED — HaCarmelli, in Dovid HaMelech’s time, causing him no end of trouble as well.1

This makes the confrontation between Bilaam and the Jewish people even more fascinating. For, as the Arizal explains:

The good Nefesh of Hevel was given to Shais, who completely rectified it … After the Nefesh was completely rectified, it was then possible to rectify the Ruach … The Ruach reincarnated into Noach HaTzaddik …

Later, the Neshamah reincarnated into Moshe Rabbeinu, since it never contained an element of evil. Thus, it says regarding him, “She saw that he was good” (Shemos 2:2), unlike with respect to the Nefesh and Ruach which had evil mixed into them. (Sha’ar HaGilgulim, Ch. 29)

Therefore, while the evil part of Hevel’s Nefesh tried to curse the Jewish people up in the hills beyond the eyeshot of the Jewish people, the Neshamah of Hevel, inside Moshe Rabbeinu, was in the camp below, leading the Jewish people towards Eretz Yisroel. What is the meaning of that?

It is also interesting to note that both Moshe Rabbeinu and Bilaam possessed the power speech: What induced Moav to consult with Midian? When they saw that the Jewish people were victorious in a supernatural way, they said, “The leader of this people grew up in Midian. We will ask them about main characteristic.” The told him, “His power lies in his mouth,” at which point they said, “Then we must come against him with one whose power lies in his mouth!” (Rashi, Bamidbar 22:4)

For Moshe Rabbeinu, it was the power of prayer. For Bilaam, it was the ability to bless or curse. But, for both of them, their power of speech was rooted in Hevel, as the Arizal explains: Hevel is one who speaks, b’sod the “breath — hevel — of the mouth.”

Therefore, one who is from the root of Hevel will discourse and speak much … (Sha’ar HaGilgulim, Ch. 36)

Hence, though one of the last people we might think of while reading this week’s parsha is Hevel, in truth, it is his soul that is very much the basis of what takes place in this week’s reading. On a Pshat-level, that may sound strange. However, on the level of Sod, it makes perfect sense:

As a result of the sin of Kayin and Hevel, the Neshamos became mixed together in the Klipos — spiritual impurity — and that this is called, “the mixture of good and evil.” From that time onward, the souls have been undergoing a process of “separation” from within the klipos, just as silver is smelted from waste … Once the separation of all the souls has been completed … the spiritual “refuse,” which is only removed through deeds, will collapse on its own … For, holiness is the life that results from separating from spiritual impurity, which is called “death.” Therefore, they will no longer have any life, and they will disappear like smoke, as it says, “Death will be absorbed forever” (Yeshayahu 25:8), once all of the souls are separated out. Thus, taking the first letter of each word (of the verse just stated), they spell the word “Hevel.” This is to allude to the fact that only when all of the reincarnations of Hevel are complete, which is Moshe Rabbeinu, who reincarnates in every generation to separate out the souls from amongst the spiritual waste, will Moshiach come, and death will be absorbed forever. (Sha’ar HaGilgulim, Ch. 20)

Perhaps, this is why the Jewish people take a back seat in this week’s parsha, and Bilaam gets to sit up front. It’s not about the “Heh” of Hevel, it’s about the Bais-Lamed in Bilaam, and Balak for that matter, that is in serious need of rectification. It’s about recovering the Bais-Lamed from the Klipos — Bilaam — which this week’s parsha sets up. For, in Parashas Mattos,

Bilaam will get his due, at long last, when he is killed by Pinchas for his role in the crisis that occurs at the end of the parsha, with the women of Midian. However, the fact that Bilaam reincarnated into Navel HaCarmelli, who tried to curse Dovid HaMelech, shows that the work was not completed with the death of Bilaam. Indeed, perhaps it set up the final confrontation that will cause the Final Redemption, and Yemos HaMoshiach: In the future Moshe himself will reincarnate and return in the last generation, as it says, “you will die with your fathers and rise up.” However, in the final generation, the “Dor HaMidbar” will also reincarnate with the Erev Rav, and this is what the verse also says, “this people will rise up.” Hence, there is not a single generation in which Moshe Rabbeinu does not return b’sod, “The sun rises and the sun sets” (Koheles 1:5) and, “One generation goes and another comes” (Koheles 1:4), in order to rectify that generation. Thus, the Generation of the Desert along with the Erev Rav reincarnate in the final generation, “like in the days of leaving Egypt” (Michah 7:15). (Sha’ar HaGilgulim, Ch. 20)

Maybe, this is why the mizbayach — the altar — in the Bais HaMikdosh was 32 amos by 32 amos, the numerical value of Bais-Lamed. It was a way of counteracting the Bais-Lamed of Hevel, which incidentally, is the reverse spelling of Lamed-Bais, which spells “heart.” This would imply that Bais-Lamed represents a “backwards” heart. The tikun of Jewish history may not be to eliminate the Bais-Lamed, but to reverse it, as the prophets says:

I will give you a new heart and put a new spirit within you; and I will remove the heart of stone from your flesh and give you a heart of flesh. (Yechezkel 36:26)

It had been Bilaam’s goal to do just the opposite. It must be our goal to help the prophecy come true.

The values of bal tashchit (not to waste) is an important issue. The speaker at this years' Tu B'Shevat Seder that I attended made us aware of global changes and pointed out important issues. He showed us how to help save energy and cut down on polution made by the production of electricity.

He suggested that we individually do our part and had a simple solution on cutting down energy consumption. He mentioned that he has achieved major cut in his hydro bill as a wonderful side affect and taught others locally and in Israel as well resulting for the people in Israel to save 80% on their bill. The simple tool used....power bars.

He demostrated that electrical appliances plugged when not in usage consume quite a bit of energy. ie. modems, microwave, oven clocks, TV, computers. He mentioned that if one is religious about turning off these appliances with a power bar, there will be major cut down on bills.

TV that uses remote, is in effect using energy since it waits for someone to turn it on with it. Lights left on and cell rechargers that are plugged to the walls (notice that they are hot even when not in use) consumes energy that is wasted. In essence, installing the power bars and conciously turning it off when not using the appliance will unconciously effect the world.

As a Canadian citizen, I grew up with the thought of keeping Canada Canadian and not let Americans influence too much on Canada. That is part of the beauty of Canada.

With US asking for your support in regards to Israel and the peace talks, I need to ask you to please exercise extra caution. Over the years, I learned much and today's Islam is definately not the good Canadian citizens that we know.

As for today's situation in Israel, Israeli citizens are suffering and the suffering was brought by US pressure on Israel who is a loyal ally. Islam's goal in Israel is to dominate the country and destroy the State of Israel. In essence, it is not about land, it is about control and Islam.

Israel is a microcosm of the world. The suffering of the people who call themselves Palestinians was brought by their leaders on purpose so future generations would cry out and compassionate people would respond. Arafat made sure of that.

Palestinian school books were re-written to accomodate their ideology. Arafat stated in one of his speeches "first Saturday then Sunday". This all should not be taken lightly. What he meant was first we get the Jews then the Christians. I often wonder what is being done with the money that all nations are so readily giving to them.

Here is today's Israeli reality:

The displacement of solid, salt of the earth and upstanding former Gush Katifers/Gaza citizens brought overwhelming negative psychological, family and economical results. It also brought them homelessness. Suicide were attempted and families were broken.

Clearing up a misconception...
There is a big misconception with Chanukah in regards to gifts. Today's gift idea may have derived from non-Jewish sources. The Jewish tradition on Chanukah is to give money/coins to children that could amount to quite a lot if they had lots of relatives and friends in the area. Originally children would go to relatives and friends every day and get their coins.

Pushing Terrorists Off Of Cyberspace!

It would appear that terrorists using YouTube to spread videos depicting terrorist activity are being pushed off cyberspace.
Our intrepid blog editor, Jerry Gordon, has been posting about and monitoring this issue for some time, as well as communicating with key Members of Congress about the problem.
Senator Lieberman, Chairman of the Senate Homeland Security and Government Affairs Committee, has conducted hearings on this issue. He brought pressure on Google/YouTube to ban the posting of videos that show terrorist actions, such as attacks on American troops.
That resistance and pressure to get rid of terrorist training videos on YouTube is working.
Recently our talented colleague Joseph Shahda came across a chat room thread below on the terrorist website “Ekhlaas.”
The reaction from Senator Lieberman’s staff can be summed up in one word -- “wonderful.”

One organization that asked Women in Green to join them in their demonstration, turned out to be affiliated with the Hillary Clinton Campaign and the promotion of gay rights in the US.

Having just listened to an interview with Amb. John Bolton and Natan Sharansky on Lori Lowenthal Marcus and Steve Feldman on the ZoA MiddleEast News Hour on WNWR.com, Listen here at http://www.zoaphilly.org/. I would say that Dr. Rice follows what Bolton called "the General Colin Powellschool" of listening to the Arabists at State and the Islamist propagandists here in America and advocating on their collective behalves before the President and the NSC staffs. But then, the President and Dr. Rice are leading this country astray and into a cataclysmic abyss based ondenial and delusion akin to what British PM Chamberlain did in September, 1938. Israel, according to Amb. Bolton has weak leadership and the Palestinians are even weaker ones. Saudi Arabia and the Gulf Emirates member oif the Arab League anti-Israell boycott have trillions of petrodollars. They could part with 1/10th of one-quarter of one percent to assist their Mulsim brothers in the PA West Bank and Gaza, but won't.

Blame it on the Jews and the West and let us pay for the huge open running sewer in Gaza and delivery of armored cars to the PLO-Fatah along with 1,000 weapons. And let us not forget the 'good faith release' of another Palestinian terrorist prisoners. The sands in the nuclear hourglass as commented on by Amb. Bolton held by Iran have about been drained, what follows will be the dawn of an artificial sun on the Persian New Year in 2008 that coluld obliterate Israel and sections of the Arab Middle East. Boilton had been an early and vigorous advocate warning in the highest councils of government about the menace of not only Syria's nuclear threat, but, as I also pointed out Syria's massive bio-warfare thrteat to Israel and US. A threat jointly developed with Iran, North Korea, Russia,with 'gifts' of pathoigens and dispersal technologies from Saddam Hussein and even purchase of technology from Germany and the US. We are indenial about that threat to Israel and us. The American administration's new Middle East peace initiative is based on wishful thinking.

Late reports tell us that Mahmoud Abbas is making more demands before agreeing to attend the Summit to be sponsored by the United States in Annapolis, Md. Secretary of State Condoleezza Rice is determined to conclude an agreement with Abbas, who will promise peace in exchange for every conceivable tangible demand from Israel.

The Palestinians demand almost all of Judea, Samaria and Gaza, half of Jerusalem, the entire Temple Mount, the right of return of 4 million Palestinian refugees, border areas from before the Six-Day War, freedom for all PA prisoners, the right to open Palestinian institutions in Jerusalem, return of the terrorists deported from the Church of the Nativity and immediate retreat to the September 2000 lines (these are the lines from which the Arabs launched the second intifada, in which Yasser Arafat and Abu Mazen's Fatah terrorists killed more than 1,000 Israelis). Iin addition, they demand the execution of the third stage of the Oslo Accords, an end to building in the settlements, and cessation of the construction of the Mughrabi Bridge in Jerusalem.

At the U.S. Naval Academy in Annapolis, Md., next week, the current secretary of state will illustrate her predecessor's point."Annapolis," as it is spoken of in diplomatic circles, was conceived earlier this year by the Bush administration as a landmark conference that would revive Israeli-Palestinian peace talks and lead to a final settlement by January 2009. It was to be modeled on the Madrid conference of 1991, which brought Israeli leaders face-to-face with their Arab counterparts and, as it seemed at the time, created a new paradigm in the affairs of the Middle East. Back then, the idea was that the Iron Wall between the Jewish state and its neighbors could be brought down just as the Berlin Wall had. Today, the operative theory is that Israel's neighbors, fearful of Iran's growing regional clout, have a newfound interest in putting the Israeli-Palestinian conflict to rest.Nice theory--if only the locals would get with the concept. The Egyptians are openly skeptical about the conference, which they say lacks "an endgame." The Saudis, supposedly among the beleaguered and newly pliable Sunni powers, can hardly be bothered with Annapolis; even now it's unclear whether their foreign minister will attend. Palestinian President Mahmoud Abbas has told the Saudis he would rather resign than attend a conference that achieves nothing. Survey: Americans see Israel as ally

A large percentage of Americans continue to support the State of Israel, especially in relation to the Palestinians and the "war on terror," according to a survey released Sunday by the Anti-Defamation League (ADL).

The survey reveals that a large majority of Americans, 65%, see Israel as an important ally.

A 2005 ADL poll showed nearly identical numbers of Americans with this view, indicating that American support for Israel has stayed strong and relatively constant over the last few years.

Israeli lawmakers move to keep hold of East Jerusalem

JERUSALEM - Israel's parliament gave preliminary approval on Wednesday to legislation that would make it more difficult to give up parts of Jerusalem in any peace deal with the Palestinians.The vote, two weeks before a U.S.-led conference on Palestinian statehood, underscored the problems Prime Minister Ehud Olmert could face in rallying his diverse coalition around any future compromise aimed at resolving one of the most divisive issues of the Middle East conflict.The proposed bill stipulates that amendment of a 1980 law that declared all of Jerusalem Israel's "complete and united capital" would require the approval of 80 of parliament's 120 legislators, instead of 61 under current rules.

Talk About Divide and Conquer

If President Bush and Secretary of State Condoleezza Rice have their way, the map you see on the left will be the new configuration of Israel Â dividing Israel in half with ÂPalestineÂ in the middle. The miniscule state of Israel will grow even smaller than it already is after losing territory that the Palestinians are demanding.

The land they ask for, more than 95% of the West Bank, will give them sovereignty over almost all of the Christian and Jewish Holy Land Sites. In addition Israel will be reduced on it eastern border to a highly populated corridor that in some places is only 9 miles wide.

How would you defend a country only 9 miles wide?

The forthcoming Summit at Annapolis will seal the deal. It will impact history in an unprecedented way by creating a 23rd Arab state Â one led by the Hamas and Fatah terrorist organizations vowing to destroy Israel. The scheduled date is November 26, but the Administration has been evasive in publicizing details of the time and place. They say it will be held in the historic Naval Academy.

When will the media take notice? After the deed is done and it is too late? We feel that the media, especially in the Washington, DC-Maryland area should begin to focus on this and all of the dissension it is creating among various groups who are organized in opposition. So far the entire event has been cloaked in secrecy, while reports on private meetings and negotiations with foreign officials are being leaked.

Six rallies opposing the Summit are set to take place, one in Washington, another in Annapolis and four more across the country. The public is encouraged to participate. They are scheduled as follows:

Weapons smuggling tunnels in the patronage of Egypt:

Partial Video Description: The Arabs in Gaza continue to dig lots of tunnels from Sinai to Gaza in order to smuggle weapons. IDF managed to destroy 7 of them couple of days ago but those are only the tip of the icebeg cause there are lots of more inside the Gaza strip and in order to reach them there's a need for a large scale operation that may take place in the near future. And the Egyptians? They are allowing the Arabs in Gaza to smuggle, and this is probably one of the benefits of the "peace agreement" between Israel and Egypt. And the Qassam firing? Article: Alternative 'Jewish Sovereignty' Summit Planned

A dozen Jewish organizations have united to hold a "summit" calling for Jewish sovereignty over all of the Land of Israel, meeting on the same day as the Annapolis summit. The title: Sovereignty for the Jewish Nation Over the State of the Land of Israel.

Spokesperson Susie Dym explained, "What is happening in Israel, and consequently among passive Jewish leaders elsewhere, is that our political leadership has abandoned the goal of furthering the Jewish people in the Jewish state, and has gone towards the goal of building a Palestinian state and advancing the Palestinians' interests. The situation has become absurd, in that our government is working towards the antithesis of what it should be."

"Recognizing that the Jewish Nation does not have a representative body," the formative statement begins, "and greatly fearing that the government in Israel is undermining the fundamental interests of Jewish existence (based on its declarations and actions in anticipation of the Annapolis summit), we - many right-wing movements and organizations - have united together to convene a counter-summit. Our goal is to emphasize what we stand 'for,' not 'against.'"

"Our door is open to all those who want to further the interests of the Jewish people," Dym said.

The founding session of the New Jewish Congress will be held on the 17th day of Kislev, Nov. 27, in Jerusalem - the day on or after the scheduled Annapolis summit. The date for the Annapolis meeting has not yet been finally set.

The idea of the alternative summit, the organizers say, is to "establish the first-stage organizational and conceptual skeleton that will promote a congress to represent the entire nation, including hareidim, during the course of Nissan (April 2008)."

Among the initiating organizations are: Manhigut Yehudit (Jewish Leadership), Land of Israel Task Force, Cities of Israel, the Temple Institute, and the Sanhedrin. Also participating are Mateh Tzafon, Task Force to Save the Land of Israel, Women in Green, Nahalal Forum, and Honenu.

Rabbis who have lent their support include Kiryat Arba/Hevron Chief Rabbi Dov Lior, Sanhedrin President Rabbi Adin Steinzaltz, Rabbi Shalom Dov Wolpe of Chabad, Rabbi Yoel Schwartz, Rabbi Yisrael Ariel and more.

Participating public figures include Yoram Ettinger, Prof. Paul Eidelberg, Dr. Yossi Ben-Aharon, Prof. Gabi Barkai, Prof. Hillel Weiss, Atty. The Origin of the “Mandate for Palestine”

The legally binding Mandate for Palestine document was conferred on April 24 1920, at the San Remo Conference and its terms outlined in the Treaty of Sevres on August 10 1920. The Mandate’s terms were finalized by the Council of the League of Nations on July 24 1922, and became operational in 1923.

This historical League of Nations document, laid down the Jewish legal right to settle anywhere in western Palestine, a 10,000 square mile area between the Jordan River and the Mediterranean Sea, an entitlement unaltered in international law and valid to this day.¹

The UN Charter does not grant the General Assembly or the International Court of Justice the authority to assign or affect ‘ownership’ of the Territories.

The Mandate Defined Where Jews are and are not Permitted to Settle

The six page “Mandate for Palestine” document did not set the borders – leaving this for the Mandator to stipulate in a binding appendix to the final document in the form of a memorandum, but Article 6 of the Mandate says clearly:

“The Administration of Palestine, while ensuring that the rights and position of other sections of the population are not prejudiced, shall facilitate Jewish immigration under suitable conditions and shall encourage, in co-operation with the Jewish agency referred to in Article 4, close settlement by Jews on the land, including State lands and waste lands not required for public purposes” [italics by author].

Article 25 of the “Mandate for Palestine” entitled the Mandatory to change the terms of the Mandate in the part of the Mandate east of the Jordan River:

“In the territories lying between the Jordan and the eastern boundary of Palestine as ultimately determined, the Mandatory shall be entitled, with the consent of the Council of the League of Nations, to postpone or withhold application of such provision of this Mandate as he may consider inapplicable to the existing local conditions …”

Great Britain activated this option in the above-mentioned memorandum of September 16 1922, which the Mandatory sent to the League of Nations and which the League subsequently approved – making it a legally binding integral part of the Mandate.

Thus the “Mandate for Palestine” brought to fruition a fourth Arab state east of the Jordan River, realized in 1946 when the Hashemite Kingdom of Trans-Jordan was granted independence from Great Britain. All the clauses concerning a Jewish homeland would not apply to this part (Trans-Jordan) of the original Mandate, stating clearly:

“The following provisions of the Mandate for Palestine are not applicable to the territory known as Trans-Jordan, which comprises all territory lying to the east of a line drawn from … up the centre of the Wady Araba, Dead Sea and River Jordan. … His Majesty’s Government accept[s] full responsibility as Mandatory for Trans-Jordan.”

The creation of an Arab state in eastern Palestine (today Jordan) on 77 percent of the land mass of the original Mandate for Jews, in no way changed the status of Jews west of the Jordan River and their right to settle anywhere in western Palestine, between the Jordan River and the Mediterranean Sea.

These documents are the last legally binding documents regarding the status of what is commonly called “the West Bank and Gaza.”

The memorandum (regarding Article 25) is also the last modification of the Mandate on record² by the League of Nations or by its legal successor – the United Nations – in accordance with Article 27 of the Mandate that states unequivocally:

“The consent of the Council of the League of Nations is required for any modification of the terms of this mandate.”

United Nations Charter Article 73 recognizes the UN’s commitments of its predecessor – the League of Nations – and promises to carry through to fruition the mandate system the League of Nations created, enshrined in Article 22 of the League of Nations Charter.³

Political Rights Were Granted to Jews Only

The Mandate for Palestine clearly differentiates between political rights – referring to Jewish self-determination as an emerging polity – and civil and religious rights, referring to guarantees of equal personal freedoms to non-Jewish residents as individuals and within select communities. Not once are Arabs as a people mentioned in the Mandate for Palestine. At no point in the entire document is there any granting of political rights to non-Jewish entities (i.e., Arabs) because political rights to self-determination as a polity for Arabs were guaranteed in three other parallel Class “A” mandates – in Lebanon, Syria and Iraq. Article 2 of the Mandate for Palestine states explicitly that the Mandatory should:

“… be responsible for placing the country under such political, administrative and economic conditions as will secure the establishment of the Jewish national home, as laid down in the preamble, and the development of self-governing institutions, and also for safeguarding the civil and religious rights of all the inhabitants of Palestine, irrespective of race and religion.” [italics by author]

Jewish Rights to Palestine were internationally guaranteed.

In the first Report of The High Commissioner on the Administration of Palestine 1920-1925 to Winston Churchill, the Secretary of State for the Colonies, published in April 1925, the most senior official of the Mandate for Palestine - the High Commissioner for Palestine, underscored how “international guarantee[s]” for the existence of a Jewish National Home in Palestine were achieved:

“The [Balfour] Declaration was endorsed at the time by several of the Allied Governments; it was reaffirmed by the Conference of the Principal Allied Powers at San Remo in 1920; it was subsequently endorsed by unanimous resolutions of both Houses of the Congress of the United States; it was embodied in the Mandate for Palestine approved by the League of Nations in 1922; it was declared, in a formal statement of policy issued by the Colonial Secretary in the same year, ‘not to be susceptible of change’; and it has been the guiding principle in their direction of the affairs of Palestine of four successive British Governments. The policy was fixed and internationally guaranteed.”

United State Government Policy

On June 30, 1922, a joint resolution of both Houses of Congress of the United States unanimously endorsed the Mandate for Palestine - the irrevocable right to settle in the area of Palestine - anywhere between the Jordan River and the Mediterranean Sea .

On September 21, 1922 President Warren G. Harding, (the twenty-ninth president 1921-1923) signed the joint resolution of approval to establish a Jewish Homeland in Palestine.

Article 80 - “Mandate for Palestine” Valid to this Day

International law, the UN Charter, and specifically Article 80 of the UN Charter implicitly recognize the “Mandate for Palestine” of the League of Nations. This Mandate granted Jews the irrevocable right to settle in the area of Palestine, anywhere between the Jordan River and the Mediterranean Sea, a right unaltered in international law and valid to this day.

The International Court of Justice reaffirmed the validity of Article 80 in three separate cases:

Advisory Opinion of 11 July 1950, in the “… question concerning the International States of South West Africa.”⁴
Advisory Opinion of 21 June 1971 “The International Court of Justice has consistently recognized that the Mandate survived the demise of the League [of Nations]…” Security Council resolution 276 (1970).⁵ (11654) [italics by author].
Advisory Opinion of July 9 2004 in the case of the “legal consequences of the construction of a wall in the occupied Palestinian territory”⁶

In other words, neither the ICJ nor the UN General Assembly can arbitrarily change the status of Jewish settlement as set forth in the “Mandate for Palestine,” an international accord that was never amended.

All of western Palestine, from the Jordan River to the Mediterranean Sea, including the West Bank and Gaza, remains open to Jewish settlement under international law until a legally binding document – in Israel’s case, a peace treaty between Arabs and Jews that was called for in Security Resolution 242 and 338 – changes this.

Professor Rostow’s position concurred with the ICJ’s opinion as to the “sacredness” of such trusts:

“A trust” – as in Article 80 of the UN Charter “does not end because the trustee dies … the Jewish right of settlement in the whole of western Palestine – the area west of the Jordan – survived the British withdrawal in 1948. … They are parts of the mandate territory, now legally occupied by Israel with the consent of the Security Council.”⁷

Challenging the Mandate for Palestine

ICJ: The “Mandate for Palestine” is a Class “A” Mandate

Many assumed that the “Mandate for Palestine” is a Class “A” mandate,⁸ a common, but inaccurate assertion that can be found in many dictionaries and encyclopedias, and is frequently used by the pro-Palestinian media and lately by the ICJ. In the Court opinion, the Bench erroneously states that:

“Palestine was part of the Ottoman Empire. At the end of the First World War, a class [type] ‘A’ Mandate for Palestine was entrusted to Great Britain by the League of Nations, pursuant to paragraph 4 of Article 22 of the Covenant …”⁹ [italics by author].

Indeed, Class “A” status was granted to a number of Arab peoples who were ready for independence in the former Ottoman Empire, and only to Arab entities.¹⁰ Palestinian Arabs were not one of these ‘Arab peoples.’ The Palestine Royal Report clarifies this point:

“(2) The Mandate [for Palestine] is of a different type from the Mandate for Syria and the Lebanon and the draft Mandate for Iraq. These latter, which were called for convenience “A” Mandates, accorded with the fourth paragraph of Article 22. Thus the Syrian Mandate provided that the government should be based on an organic law which should take into account the rights, interests and wishes of all the inhabitants, and that measures should be enacted ‘to facilitate the progressive development of Syria and the Lebanon as independent States’. The corresponding sentences of the draft Mandate for Iraq were the same. In compliance with them National Legislatures were established in due course on an elective basis. Article 1 of the Palestine Mandate, on the other hand, vests ‘full powers of legislation and of administration’, within the limits of the Mandate, in the Mandatory”¹¹ [italics by author].

The Palestine Royal Report highlights additional differences:

“Unquestionably, however, the primary purpose of the Mandate, as expressed in its preamble and its articles, is to promote the establishment of the Jewish National Home.

“… Articles 4, 6 and 11 provide for the recognition of a Jewish Agency ‘as a public body for the purpose of advising and co-operating with the Administration’ on matters affecting Jewish interests. No such body is envisaged for dealing with Arab interests.¹²

“… But Palestine was different from the other ex-Turkish provinces. It was, indeed, unique both as the Holy Land of three world-religions and as the old historic homeland of the Jews. The Arabs had lived in it for centuries, but they had long ceased to rule it, and in view of its peculiar character they could not now claim to possess it in the same way as they could claim possession of Syria or Iraq”¹³ [italics by author].

There is much to be gained by attributing Class “A” status to the Mandate for Palestine. If ‘the inhabitants of Palestine’ were ready for independence under a Class “A” mandate, then the Palestinian Arabs that made up the majority of the inhabitants of Palestine in 1922 (589,177 Arabs vs. 83,790 Jews)¹⁴ could then logically claim that they were the intended beneficiaries of the Mandate for Palestine – provided one never reads the actual wording of the document:

The “Mandate for Palestine” never mentions Class “A” status at any time for Palestinian Arabs.
Article 2 of the document clearly speaks of the Mandatory as being:
“responsible for placing the country under such political, administrative and economic conditions as will secure the establishment of the Jewish national home” [italics by author].

The Mandate calls for steps to encourage Jewish immigration and settlement throughout Palestine except east of the Jordan River. Historically, therefore, Palestine was an ‘anomaly’ within the Mandate system, ‘in a class of its own’ – initially referred to by the British as a “special regime.”¹⁵

Palestine was part of the territories promised to the Arabs.

Addressing the Arab claim that Palestine was part of the territories promised to the Arabs in 1915 by Sir Henry McMahon, the British Government stated:

“We think it sufficient for the purposes of this Report to state that the British Government have never accepted the Arab case. When it was first formally presented by the Arab Delegation in London in 1922, the Secretary of State for the Colonies (Mr. Churchill) replied as follows:

“That letter [Sir H. McMahon’s letter of the 24 October 1915] is quoted as conveying the promise to the Sherif of Mecca to recognize and support the independence of the Arabs within the territories proposed by him. But this promise was given subject to a reservation made in the same letter, which excluded from its scope, among other territories, the portions of Syria lying to the west of the district of Damascus. This reservation has always been regarded by His Majesty’s Government as covering the vilayet of Beirut and the independent Sanjak of Jerusalem. The whole of Palestine west of the Jordan was thus excluded from Sir H. McMahon’s pledge.

“It was in the highest degree unfortunate that, in the exigencies of war, the British Government was unable to make their intention clear to the Sherif. Palestine, it will have been noticed, was not expressly mentioned in Sir Henry McMahon’s letter of the 24th October, 1915. Nor was any later reference made to it. In the further correspondence between Sir Henry McMahon and the Sherif the only areas relevant to the present discussion which were mentioned were the Vilayets of Aleppo and Beirut. The Sherif asserted that these Vilayets were purely Arab; and, when Sir Henry McMahon pointed out that French interests were involved, he replied that, while he did not recede from his full claims in the north, he did not wish to injure the alliance between Britain and France and would not ask ‘for what we now leave to France in Beirut and its coasts’ till after the War. There was no more bargaining over boundaries. It only remained for the British Government to supply the Sherif with the monthly subsidy in gold and the rifles, ammunition and foodstuffs he required for launching and sustaining the revolt”¹⁶ [italics by author].

Feiglin to Bibi: Say You'll Never Honor J'lem Division

(IsraelNN.com) The head of the "Manhigut Yehudit" (Jewish Leadership) faction in the Likud party, Moshe Feiglin, is putting pressure on the party's leader, Opposition Head Binyamin Netanyahu, to announce that he will not honor any agreement that cedes parts of Jerusalem, if and when he becomes Prime Minister.

In a letter made public Tuesday, Feiglin demanded that Netanyahu announce that "the Likud movement sees negotiations on Jerusalem's future as illegitimate and that a future government headed by the Likud will not consider itself bound by decisions reached in such negotiations."

Feiglin, who received 23% of the registered Likud members' votes in the August primaries, warned that if Netanyahu does not rise to the challenge within the next few days, he will act to convene the Likud's Central Committee (Merkaz) in order to force a decision that makes it incumbent on the Likud's elected leaders to regard any decision about dividing Jerusalem as nonbinding.

'Jerusalem can unite the Jews'Feiglin wrote: "This announcement, along with a public campaign that the Likud under your leadership will conduct, can prevent negotiations from continuing, because they will become meaningless when support for the Israeli government and its head drops to single digits," he wrote. "Jerusalem can unite the entire Jewish public in Israel. I have no doubt that the leaders of the national parties and even some of the Knesset Members from [ruling party] Kadima, will join this struggle, which is one for our survival.”

Prime Minister Ehud Olmert said Monday that he is "not convinced" that it was necessary to add the "refugee camp" of Shuefat, as well as Arab a-Sawahra, Walajeh and other villages to Jerusalem's municipal area after the 1967 Six-Day War. He spoke at a special Knesset session marking six years since the assassination of Minister Rehavam "Gandhi" Ze'evi.

Kadima party MK Ze'ev Elkin said Monday that he was worried about talk of dividing Jerusalem. "We need to discuss the matter of Jerusalem in the Kadima faction," he said. "I think that there is no way people will live normally in Pisgat Ze'ev if we return [nearby] Shuefat."

Both Netanyahu and veteran Likud MK Reuven Rivlin made impassioned speeches two weeks ago in which they called upon the Yisrael Beiteinu (Israel Our Home) and Shas parties to leave the coalition in order to prevent concessions in Jerusalem.

I am not ashamed to admit it. I am afraid. I am afraid that my people
and my state are marching inexorably to a horror that can best be
unimagined. And I am afraid, for the first time, that we are in the
hands of people so blind and so mad and so un-Jewish that we may not
be able, G-d forbid, to avert the catastrophe.

Last week I was at the Western Wall. It was the Friday after the
Friday when the Moslems, standing on the Temple Mount -- OUR Temple
Mount -- hurled rocks and stones on the Jews praying below. It was the
Friday after the Friday when Jews, in the sovereign State of Israel,
praying at the remains of the Holy Temple, fled in panic from the
Moslems who cried "Allah Akhbar!" It was the Friday after the Friday
in which Jews in the State of Israel fled in panic from Moslems who
proclaimed their dream of destroying the Jewish State.

I was at the Wall on the Friday after the Friday. No less than 3,000
(!) security forces were there to protect the Jews in their own state
from Moslems who once so trembled before the Jew. Three thousand (!)
security forces to protect Jews -- who were so frightened that they
stayed away in droves. The proud State of Israel. . . .

I am afraid. I am afraid that the Jews of insanity who run this land
will destroy us, even as all the impossible Herut fools in the United
States continue to write columns attacking the PLO.

I am afraid. Last week, I was at the Hebron Jewish cemetery. I saw the
swastikas and the Arab graffiti of hate on the walls. I saw the
desecrated tombstones. I watched as the Jews held a memorial service.

A memorial service! They murder us and they dececrate us and we react
with memorial services!

That day a rock smashed through the car window of a Jew traveling in
Bethlehem, injuring him in the temple, cheek and shoulder. That day,
600 apple and 50 olive trees were destroyed along with tens of
thousands of commercial flowers at the settlement of Nvei Michael. But
I return to the cemetery.

How many people, how many Jews, in the world heard of the Hebron
cemetery outrage? No matter. How should they have heard of it when the
Prime Minister of Israel, the President of Israel, its Knesset and its
governmental leaders did not find it necessary to shout their
indignation.

A week of Chillul Hashem, of desecration. And the men who run this
State of Disorder sit by, hapless and impotent, silent partners to
Desecration. And I know that the Almighty's rage will lash out at us
for allowing His name to be defiled. And I am afraid for much more.

Last week I watched as the insanity spread and reached new heights.
The Border Police, the elite security forces, were sent to make
arrests in the murderous village of Nahalin. They were attacked by
hundreds of stone throwing, Molotov cocktail-throwing Arabs. The
Border Police, under a murderous barrage, fired and killed four Arabs.
Only four Arabs. The Arabs shrieked in protest; the pathologically
sick leftists joined them and demanded and "investigation"; the army
command, led by two kibbutz members, Chief of Staff Don Shomron and
Central Command OC Amram Mitzna, so ordered. The Border Police were
accused of "overreacting" and "indiscriminate shooting," and two of
their officers were suspended from duty.

I am afraid. Yesterday they destroyed the army with their insane
orders that hobbled the troops, causing them to fear to deal with the
Arabs as normal soldiers should. Today, they take the best of the
security forces, the Border Police, and destroy them, too. And they
must be stopped before they destroy the Jewish state -- and the Jew.

They protest over Nahalin? They investigate attacks on Nahalin? Do you
know what Nahalin is? Do you know who the Arabs of Nahalin are? Of
course not, so read. And learn. And grow angry and bitter -- and do
something.

In 1948, the villagers of Nahalin participated in the massacre of 35
Jewish students coming to the rescue of Kfar Etzion. They murdered
them in cold blood. In 1954, two Jews were murdered by Nahalin
villagers leading to a reprisal raid on the village by Israel. At that
time, the UN comdemned the Jews. Today, the Jews do.

When Israel liberated the land in 1967, the normal , sane thing to
have done would have been to drive the scum out. But we are not
normal. We are not sane. We allowed them to remain along with all the
rest of them -- murderous Ishmaelites who cannot live with Jews or
with themselves (and let us raise a toast to gloriously peaceful
Beirut). And now we investigate and condemn our Border Police for
having "fired indiscriminately" on the village that murdered Jews
yesterday, that dreams of murdering them tomorrow, and that attacked
the Border Police with hate and rocks and firebombs in their hands.

We are insane. We are in the hands of leaders who are insane and who
march us down the road to horror and destruction. I am afraid. I am
afraid of a government that, instead of supporting the men whom they
send into war (and this IS a war!); instead of giving them accolades
and medals for killing the Arab enemy (and they ARE the enemy -- all
of them) -- investigates them, censures them, disciplines them.
Insanity. And I am afraid.

I am afraid. Last week I watched as the police indicted Rabbi Moshe
Levinger for doing that which any normal human being would. Driving in
the heart of Hebron, a nest of snakes and scorpions, a city of Arabs
with Jewish blood on their hands from 1929 -- his car was attacked and
a stone smashed its window. He ran out shooting at the Jew-haters and
killed one. A pity. One. He was indicted and I am afraid. For I fear
that we may be lost.

I see the leftists who control the state news media even as the
pathetic Shamir government does nothing. I see the daily barrage of
state-sponsored self-hate and self-destruction aimed at destroying the
morale of the security forces, while the tiny people who run this tiny
government sit impotent. I see the defeatists who run the
Likud-controlled Ministry of Justice indicting Jews who were attacked,
even as thearmy does the same to its soldiers, and the government of
Shamir sits in its perpetual transcendental silence. I watch Shamir
and his Likud sell out Israel through the kind of deception we learned
from Begin. He prepares elections that will seal the sovereignty of
the "Palestinians" over the land, as it leads to the autonomy of Camp
David that will whet the Arab appetite and increase the Jewish
dementia and result in a "Palestinian" state that will be a dagger in
Israel's heart.

I see all this and know that if we are to save the Jewish state and
its three-and-a-half million Jews from terrible horrors, we must rise
up and demand a fundamental change in the very system of government.
We must throw out those who destroy us from within, and keep them out.
I know that this present system of government that allows them to
control our lives and lead us to destruction, must be ended. I know
that elections must be limited only to those who understand that the
Arabs are the deadly enemy of the Jewish state, who would bring on us
a slow Auschwitz -- not with gas, but with knives and hatchets. I know
that only those groups which accept the following program should be
allowed to run for office:

To finish the Arab war against Israel with every means at our disposal
and an end to the immoral and sick "pity" for them; to remove the
Arabs from the Land once and for all; to annex Judea-Samaria-Gaza and
make them part of the Jewish State; to radically overhaul the bankrupt
education of Israel by infusing our children with Judaism and true
nationalism; to cleanse Israel radio and television of the mad and
dangerous leftists who, daily, destroy us from within.

I know that unless the people rise up and demand such a national
referendum, to dissolve the Knesset and vote on such a program, we are
lost. And I am afraid.
